BigTime Software, Inc. (“BigTime”, “we”, “our”, and “us”) respects your concerns about privacy and personal data protection and we value our relationship with you. This Privacy Policy (“Policy”) applies solely to personal information we collect from you via our website at BigTime.net (the “Site”) and through our on-demand support platform, tools and services offered on the Site (the “Service”).

Please read this Policy carefully, because by accessing and using the Site and Service you are acknowledging that you understand and agree to the terms of this Policy.

BigTime As A Service Provider

This Privacy Policy does not apply to personal information that BigTime collects and processes as a “processor” or “service provider” on behalf of our customers. BigTime uses personal information when it is a “processor” or “service provider” as directed by our customers and in accordance with our Access Service Agreement.

Personal Information We Collect

BigTime collects, and has collected in the past 12 months, the following:

Personal Information You Manually Provide. When you register for the Service or otherwise directly engage with us, we may collect the following identifiers and professional information:

  • Your name
  • Company name and address
  • Phone number
  • E-mail address
  • Credit card information

You are not required to enter your credit card information until you decide to continue with a paid plan. BigTime uses a third-party intermediary to manage credit card processing, and this intermediary is not permitted to store, retain, or use your billing
information except for the sole purpose of credit card processing on BigTime’s behalf.

If you speak with us on the telephone, we will collect any personal information you provide to us and we may record such conversations for quality assurance and training purposes.

You can modify your account information at any time by clicking on the Admin link in the global navigation bar at the top of the screen on the Site.

Information Sent to Us By Your Web Browser. We collect information that is sent to us automatically by your web browser or mobile device. This information typically includes your IP address, the identity of your Internet service provider, the name and version of your operating system, the name and version of your browser, the date and time of your visit, and the pages you visit. The information we receive may depend on your browser or device settings.

Generally, we use this information in the aggregate to help us improve this Site and make it more compatible with the technology used by our visitors. We may combine it with other information in an attempt to identify you or we may combine it with information that does identify you. We may also review our server logs for security purposes, for example, to detect intrusions into our network, and we might share our server logs, which contain visitors’ IP addresses, with the appropriate investigative authorities who could use that information to trace and identify you.

How We Use Your Personal Information

BigTime uses the personal information it collects about you to operate and make the Service available to you, for billing, identification and authentication purposes, to contact you about your use of the Service, research and analytics purposes, and to generally improve the content and functionality of the Service and Site. In addition, we use personal information to market, promote, and provide other information about our Services, manage risk and protect the Site and Services, comply with other contractual, legal, and regulatory obligations and to carry out any other purposes for which you provide consent.

Choices About Your Personal Information

In General. We respect your right to make choices about the ways we collect, use, and disclose your information. In addition, we may ask you to indicate your choices at the time and on the page where you provide your information.

Email preferences. You cannot opt out of transactional emails related to your membership/registration with the Site. However, you can opt out of promotional emails we send you. If you wish to stop receiving promotional emails, simply select “unsubscribe”
located at the bottom of each communication.

Do Not Track. We do not respond to Do Not Track (“DNT”) signals at this time.

Cookies and Tracking Technologies. When you visit the Site or use the Service, we use tracking technologies, including cookies and pixel tags to collect information and support certain features of the Site and Service. Session cookies also help us confirm your identity and are required in order to use the Service.

Users who disable their web browsers’ ability to accept cookies will be able to browse our Site, but will not be able to access or take advantage of certain aspects of the Service.

Information Disclosure

BigTime may transmit or disclose your personal information with its third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and other technology and services required to operate and maintain the Service. In addition, BigTime may disclose your personal information to our third party service providers for analytics and marketing purposes.

We may also disclose personal information:

  • To respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.
  • If we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law.
  •  In the event that we are subject to mergers, acquisitions, joint ventures, sales of assets, reorganizations, divestitures, dissolutions, bankruptcies, liquidations, or other types of business transactions.

Location of Our Site

This Site is hosted and operated in the United States. However, we and our service providers may store information about individuals in the United States, or we may transfer it to, and store it within, other countries.

If you are not a resident of the United States, you acknowledge and agree that we may collect and use your personal information outside your home jurisdiction, and that we may store your personal information in the United States or elsewhere.

Aggregate Information

BigTime may maintain, use, or disclose information collected on the Site in the aggregate. BigTime may use this data to improve the Site and the Service and for analytics and marketing purposes. BigTime may also disclose aggregated, de-identified information, and analyses and reports derived from such information, to our service providers.

Children’s Personal Information

The Service and Site are not intended for, nor does BigTime knowingly collect any personally identifiable information from children under the age of 13. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. BigTime maintains reasonable security measures to protect your information from loss, destruction, misuse, unauthorized access or disclosure. However, no data transmission over the Internet or information storage technology can be guaranteed to be 100%

We will keep your personal information only for the period reasonably necessary and proportionate to fulfill the purposes described in this Privacy Policy and in accordance with our retention policies, unless a longer retention period is permitted or required by law.

Third Party Links

Occasionally, at our discretion, we may include or offer third party products or services on our Site. These third party sites have separate and independent privacy policies. We therefore have no responsibility or liability for the content and activities of these linked
sites.

Legal Bases for Processing Personal Data

Transfers, Storage, and Processing

Our Site is hosted on servers located in the United States. If you access and use our website from a location outside of the United States, any personal data you provide to us may be transferred to and processed in the United States or any other jurisdiction in our sole discretion. While we take steps to safeguard your personal data, the United States has NOT been deemed by the European Commission to ensure an adequate level of protection for personal data.

Unresolved Complaints

If you are a resident of the EU and your inquiry with us has not been satisfactorily addressed, or if you believe we are processing your personal data not in accordance with the law or this Policy, you may file a complaint with the supervisory authority in your country of residence.

Data Privacy Framework

BigTime complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. BigTime has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF. BigTime has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles (DPF Principles), the Principles shall govern. In compliance with the DPF Principles, BigTime commits to resolve DPF Principles-related complaints about your privacy and our collection or use of your personal information. European Union and Swiss individuals with inquiries or complaints regarding our handling of personal data in reliance on the DPF should first

BigTime has further committed to refer unresolved DPF Principles-related complaints to a U.S.-based independent dispute resolution mechanism, BBB NATIONAL PROGRAMS. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed by us, please visit www.bbbprograms.org/dpf-complaints for more information and to file a complaint. This service is provided free of charge to you.

If your DPF complaint cannot be resolved through the above channels, under certain conditions, you may invoke binding arbitration for some residual claims not resolved by
other redress mechanisms.

Pursuant to the DPF Program, EU and Swiss individuals have the right to obtain our confirmation of whether we maintain personal information relating to you in the United States. Upon request, we will provide you with access to the personal information that we hold about you. You may also correct, amend, or delete the personal information we hold about you. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data transferred to the United States in reliance on the DPF Program should direct their query to [email protected]. If requested to remove data, we will respond within a reasonable timeframe.

We will provide an individual opt-out choice, or opt-in for sensitive data, before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. With respect to personal data received or transferred pursuant to the DPF Program, BigTime is subject to the investigatory and enforcement powers of the U.S. Federal Trade Commission. In certain situations, we may be required to disclose personal data in
response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

If you are an EU or Swiss Individual, where we transfer your personal data to third party service providers who perform services for us or on our behalf, we are responsible for the processing of that data by them and shall remain liable if they process your personal data in a manner inconsistent with the DPF Principles, unless we prove that we are not responsible for the event giving rise to the damage.

Pursuant to certain state laws, including the California Consumer Privacy Act (“CCPA”), BigTime makes the following disclosures regarding the personal information it discloses to third parties:

  • The right to know what personal information BigTime has collected about you, including the categories, sources, business purpose, and third parties with whom it is shared.
  • The right to delete personal information that BigTime has collected from you, subject to certain exceptions.
  • The right to correct inaccurate personal information that BigTime maintains about you.
  • The right to not receive discriminatory treatment for the exercise of your privacy rights.
